The last time the Pirate bay was taken down it ended up not returning with full functionality for a couple of months, so yesterday when a district court in Stockholm, Sweden, took down ThePiratebay.se and PirateBay.se, some fans of the long running torrent search site were worried. They needn't have been however, as within hours, the site had resurfaced with a number of new top level domains, showing its resilience to court ordered takedowns.

TPB is now available with new GS, LA, VG, AM, MN and GD domains names, really embodying the “hydra-bay,” ethos that has been part of the site's operating manual for years now.

“Congratulations to Prosecutor Fredrik Ingblad. Two years hard work to get us to change two little letters at a cost of $20,000 per letter,” the site's admins said in a statement to TorrentFreak. They even sarcastically said that had the prosecutor instead paid the admins $35,000, they would have changed domains for him, saving the tax-payer a cool $5,000.

While the new domains give the site some leeway however, traditionally new top level domains haven't lasted long, so it may only be a few more days until TPB jumps ship somewhere else.

KitGuru Says: It feels like courts and governments around the world just want to take TPB down as a matter of principle at this point. It's no longer the biggest torrent site in the world, even if it is the most well known, so downing it for a time doesn't really impact the availability of torrents.

The Pirate Bay has been playing a game of hopscotch for the past week as it changed domains multiple times, moving initially when its .SX domain was shutdown/seized, heading to Ascension Island's .AC, then to Peru and Guyana now back to Sweden with the .SE domain it used back in the day.

While this isn't the .org address that was the Pirate Bay's home for almost a decade, this is somewhat of a full circle trip, travelling through multiple domains before returning home. In the case of the Guyana .GY domain, TPB was only online there for a single day before the domain registrars took it down.

The Hydra Bay has proved impressively resilient

TorrentFreak spoke with the registry, asking it why TPB was pulled. It's response was simple and familiar: “Once a site violates our policies, it will be suspended.” Presumably it had something to do with pirated content.

The question now though is how long the torrent search site will be able to remain with its new, old .SE domain? Well chances are it could be a little longer than the last few, since the registrar in Sweden has previously stated it would only take down a domain in response to a court order, not because of simple lobby pressuring.

However even if the site does have to move, the admins have said they have upwards of 70 domains ready to use if need be, so the site will be difficult to down for good, if not impossible.

KitGuru Says: Do you guys think the authorities will ever catch up to The Pirate Bay? They've been trying for years and just can't seem to keep it down for long.

The PirateBay has been a permanent part of the internet for a long time now, but despite this, its domain hasn't been quite so stationary. We saw it go from PirateBay.org to PirateBay.se back in 2012 and now it's set to evolve into its next iteration: Piratebay.GL.

This comes because Swedish authorities seemed likely to seize the domain and not one to tempt fate, TPB staff simply moved it over to an alternative. At the time of writing, the .se domain is still working, so in the wake of the move the Swedish officials may not bother, since it won't make much difference in the end.

TPB took to the cloud last year to prevent server seizures

As TorrentFreak points out, while the move to the Greenland domain won't make much difference for Pirate Bay users, it will be a pain in the neck for those that filed DMCA takedown requests with Google, as they'll have to file them all over again for this new domain. Perhaps they'll file takedown requests, of their own original takedown requests in order to takedown the new takedown requests?

An interesting result of this domain change however, is that those whose ISPs have blocked TPB, may find some functionality returned to them. Can you access the torrent search site from your “blocked” connection?

KitGuru Says: It's beyond laughable when authorities go after The Pirate Bay these days. It'll continue to operate without problems, regardless of attempts to block its access. It's only by competing directly with it that companies will see its influence fall. Netflix and Spotify have probably done more to ‘harm' The Pirate Bay than any takedown or blocking attempts.

The Pirate Bay has been one of Sweden's most defining features throughout the 21st century so far, but that will no longer be the case, as the torrent search site has hitched up its socks and left its native shores for pastures green – and ones less filled with copyright lobby groups.

We heard last week how a copyright group known as the Rights Alliance, was threatening to sue the Swedish Pirate Party for hosting TPB's website – much in the same way as our own British Pirate party was targeted with legal action for hosting a proxy.

Due to the sheer financial weight behind an organisation that is backed by major Hollywood studios, there is little point in attempting to duke it out in court, as it would likely bankrupt the Pirate Party (if there's a miscarriage of justice here, it's that a legal fight is practically unwinnable because of the opposition's financial resources) so the site has now opened up two of its alternative hosting sources. Normally these are kept relatively secret, but perhaps in an effort to show its inability to be shut down, The Pirate Bay has announced that it is now being hosted by two other Pirate Party groups, in Norway and Catalunya.

Don't worry if you had to Google Catalunya, I did too. It's a small nation within the borders of Spain.

“TPB did of course have lots of backup transit lined up for ages. This is however the first time we are going to show two at the same time,” The Pirate Bay’s Winona told TorrentFreak.

“It will be interesting to see who is now blamed for hosting TPB. In the end, maybe the anti-interneterians will understand that they can’t win a fight when they have the people against them.”

I'd love to see this go up against Davy Jones' Kraken.

As an extra gesture of flamboyance, The Pirate Bay's website also displays a large image of a hydra, a multi-headed beast of Greek mythology as well as the following analogy:

“A typical Whac-A-Mole machine consists of a large, waist-level cabinet with five holes in its top and a large, soft, black mallet. Each hole contains a single plastic mole and the machinery necessary to move it up and down. Once the game starts, the moles will begin to pop up from their holes at random. The object of the game is to force the individual moles back into their holes by hitting them directly on the head with the mallet, thereby adding to the player's score. The quicker this is done the higher the final score will be.”

KitGuru Says: While there's a reasonable argument about whether copyright protected content should be available on TPB or not, it is completely unfair that in two countries now, associated groups have found themselves completely unable to legally defend themselves because they've been bullied by media giants. No group should have to fold simply because attempting to defend themselves would cripple their organisation's financial and functioning abilities.
