Apple is facing yet another lawsuit, this time from a group of unhappy iPhone 4s owners, who aren't too pleased about the poor performance brought on by the latest iOS 9 update. The class-action suit claims that Apple plans the obsolescence of its devices and knows of potential compatibility problems before pushing out its new updates to older devices.

iOS 9 will likely be the last update for the iPhone 4S, which came out back in 2011. According to the complaint, iOS 9 brings along a big hit to performance on the aging device and since Apple doesn't allow users to downgrade, iPhone 4s owners who updated are now stuck with the poor performance or forced to upgrade to a newer generation.

The lawsuit (via: Apple Insider) has around 100 members in total and says that Apple should be well aware of these issues following internal testing or through other means. In total, the plaintiffs are seeking $5 million from Apple, though there is an option to triple that amount.

This is partially down to the fact that each new version of iOS is designed to take full advantage of the latest hardware, which means older iPhones may end up struggling over time. That said, if day to day performance takes that much of a hit on an older iPhone, then perhaps Apple should make that clear to users before offering them the update.

KitGuru Says: I had some experience with the iPhone 4 on iOS 8 and that was pretty bad. So now with iOS 9, iPhone 4s users are likely experiencing similar performance issues, which does help perpetuate talk of intentional downgrades from smartphone makers in order to push users into upgrading. It will be interesting to see how this lawsuit plays out in particular. Do you guys ever think that smartphone makers cripple the performance of older devices on purpose? Foxconn Electronics, the world’s largest contract maker of electronics, plans to start volume production of the next-generation iPhone with a 4.7” display next month. At present it is unclear when the manufacturer intends to begin making the even bigger Apple smartphone with a 5.5” screen.

Bloomberg news agency reports that Apple’s main manufacturing partner will begin to make the eight-generation iPhone with a 4.7” display in July in a bid to ship the device to customers this September. Production of the 5.5” model is more complicated than the smaller version, which results in lower production efficiency that must be overcome before manufacturing volume can be increased, reports the agency.

The iPhone 6 models will receive brand-new design. The new smartphones will be taller and “rounder” than the current iPhone 5S models. The new smartphone will also be based on all-new system-on-chips and will use the iOS 8 operating system.

As previously reported, the release of the eight-generation iPhones has been brought forward. It is believed that the iPhone 6 4.7” will be launched in September, whereas the 5.5” model is expected to be released in October. The report from Bloomberg indicates that Apple is considering a simultaneous launch of the new iPhones.

The iPhones with large screens should help Apple to further gain high-end smartphone market share as many consumers now demand bigger displays and are looking at devices made by rival Samsung Electronics.

Apple and Foxconn did not comment on the news-story.

At the worldwide developers conference (WWDC) on Monday Apple said that shipments of its mobile devices based on the iOS operating system have exceeded 800 million units. According to Tim Cook, chief executive officer of Apple, around 130 million customers bought their first Apple mobile gadget in the past 12 months.

800 million devices include the iPhone smartphones, the iPad media tablets and the iPod touch personal digital media players. Apple first started to sell devices based on the iOS in 2007. Earlier this year it was reported that sales of the iPhone had exceeded 500 million units. Shipments of the iPad, which was first released in 2010, have exceeded 210 million units so far.

Keeping in mind that sales of Apple’s iPhone and iPad are growing, it is likely that the company will supply its billionth iOS-based device less than a year from now.

The rumours about Apple’s plans to introduce its eight-generation iPhone ahead of traditional September timeframe resurrected on Friday, when a China-based media reported that the Cupertino, California-based consumer electronics giant wants to launch its iPhone 6 with 4.7” display in August. In addition, Apple is rumoured to pull in the release of a bigger version of the iPhone 6.

Originally it was expected that Apple would unveil its all-new iPhone 6 with 4.7” display in September and then would follow up with the release of enlarged iPhone 6 with 5.5” screen sometimes in November or December. However, on Friday the Economic Daily News, one of China’s most trustworthy news-papers, reported citing sources in the supply chain that the launch of both models had been brought forward. The iPhone 6 4.7” is now expected to reach the market in August and the iPhone 6 5.5” model is projected to be unveiled in September, reports Reuters news-agency.

Pulling in the release of the new iPhone smartphones by several weeks could mean that Apple wants to sell more iPhones this fiscal year (which ends in late October). It also indicates that the company is confident that its manufacturing partner Foxconn Electronics will be able to quickly ramp up production of the new iPhone to ensure that over ten million of devices will be available for the launch weekend.

iPhones with large displays should help Apple to gain high-end smartphone market share as many consumers now demand larger screens and are looking at devices made by rival Samsung Electronics.

The Economic Daily News said that 80 million iPhone 6 handsets would be produced this year.

A Chinese blogger has published what it is claimed to be the front panel of the next-generation iPhone with enlarged display. The design of the panel resembles that of Apple iPhone smartphones and its existence may confirm that the Cupertino, California-based company is working on larger handsets.

Sina Weibo user jiezhixc has posted a photo (which was republished by AppleInsider) on which a lady with neat manicure (meaning that this is not a Foxconn factory worker) is holding a large white front panel (which resembles an enlarged iPhone panel) next to a space-gray iPhone 5s smartphone. The user claims that the piece belongs to the iPhone 6, which is expected to exist in two versions: with 4.7” display and with 5.5” display. It is unclear whether the panel is the final one, or a prototype.

The design of the alleged Apple iPhone 6 panel resembles that of other Apple smartphones, but features noticeable differences. There are cutouts for light sensor, camera, speaker and Home button. The screen’s bezel seems to be a little thinner compared to the existing models.

The whole iPhone 5s seems to be a little larger than the screen cutout of the alleged iPhone 6’s front panel, which may mean that the lady on the picture is holding a panel for the 4.7” version of the smartphone. Even in case the panel is not legitimate, it gives an idea regarding the size of the eight-generation iPhone, assuming that Apple does not change its design considerably.

Apple iPhone 6 is rumoured to be released this September in 4.7” version. By the end of the year it is expected that Apple will introduce a 5.5” flavour of the handset. Both smartphones are projected to be based on the A8 application processor and feature a number of hardware and software innovations.

Apple did not comment on the news-story.

According to Strategy Analytics, the Samsung Galaxy S III outsold and dethroned the Apple iPhone 4S as the best selling smartphone in Q3 2012. Granted, the iPhone 5 did launch during this period but it goes to show that Samsung is now as large, if not larger, than Apple.

During the quarter Samsung sold 18 million Galaxy S III units, equating to a massive 10.7% of the global smartphone market. Behind it was the Apple iPhone 4S with 16.2 million units sold (9.7% market share) while the latest iPhone managed sales totalling 6 million for 3.6% of the smartphone market.

While we could argue as to who actually makes the better smartphones (a debate that would never end I might add) the fact the two companies' recent flagship smartphones take up 24% of the total smartphone market is a very impressive statistic.

KitGuru says: While it looks mightily good for Samsung right now, it will be interesting where the iPhone 5 ranks in the closing quarter of 2012.

You may not have heard of Tawkon before but they are the company responsible for the below inforgraphic and applications for iOS and Android that measure radiation output of your phone. The application was removed from the App Store since it doesn't make the iPhone look too good but is still available from the Google Play Store.

As you can see the Blackberry Bold 9700 isn't too far from reaching the maximum exposure limit, while the iPhone 4S isn't far behind the Blackberry. The Galaxy S III gives off the least amount of radiation by a considerable amount, more than 3 times less than the iPhone.

Last Friday we reported that Apple's own personal assistant Siri thought that the best smartphone ever was the Nokia Lumia 900 4G. Obviously, word reached Apple and they have issued a ‘fix' that results in Siri being rather sarcastic (not to mention arrogant). As of today, the original question “what is the best smartphone ever?” is no longer directed through the knowledge database Wolfram Alpha.

A quarter of all Siri searches are directed through this service so it would appear has put a block on Siri accessing it for this particular inquiry. Instead Siri now replies with such replies as “the one you're holding” and “you're kidding, right?”

Anything you say Apple! /sarcasm

First off, Apple are obviously censoring Siri results and this is never a good thing. Secondly, Apple is playing the big and arrogant guy in the playground and chances this will backfire on them in some way.

In the last week many people have raised concerns with problems regarding the new iPhone 4s battery life. It appears this has been shortlisted to a bug in the Apple location services system in the latest iOS 5 operating system. This has been the cause of short battery life for some users who bought the latest Apple smartphone.

The bug seems to be based around the ‘Setting Time Zone' feature within the operating system. This is a part of the systems services within the location services. It is activated even when the person hasn't moved different locations or time zones. A purple arrow beside the setting is highlighting the fact that it is running often, accessing the phones location even when not asked by the user.

Locations services are well known to be a drain on a smartphone battery. It uses a wifi network name and mobile mast data, with GPS sensor input to work out a phones location. The mobile mast data is particularly intensive as it uses the signal from three close masts then triangulates the position from the three signals. The problem with the new software seems to be that it is accessing this on a regular basis, rather than once.

iDownloadBlog have a piece published on the subject, and author Oliver Haslam says “”it appears that iOS 5′s GM release introduced a bug that causes the Setting Time Zone function to keep the location tracking circuitry running constantly, draining battery power considerably.

Switching it off may mean that your iPhone will no longer set its own time zone when you travel, but that's a small price to pay for having your iPhone last more than 12 hours on a full charge… We have tested this method on 4 different iPhone 4s handsets, including an iPhone 4 and an iPhone 3GS. All have reported drastically improved battery life after switching ‘Setting Time Zone' off.”

Location Services is a very important aspect of the new smartphone, and Apple have focused on the features within the latest iOS.

Apple users are less than happy with the situation right now, and there are debates on the official forums.

Leslie101 says “I received my iphone 4s yesterday, charged it overnight and had a 30% battery drain after checking email for 10 minutes this morning. I upgraded from an iphone 3g and that 3-year-old phone holds a better charge than the 4s. Very disturbing. I hope Apple comes up with a fix fast.”

Apple have had a good first weekend, with over four million iPhone 4's sold in the first three days. This is a another new record for Apple and a good indication that Q4 revenue could be very strong for the company.

The iPhone 4s will go down in history as the last product Apple released with direct input from Steve Jobs and it has been very well received by customers across the globe. This is central to Apple maintaining a good percentage of the market until the iPhone 5 is released. Competition is heating up from the Android sector in 2011.

Analysts have claimed that Apple may sell 27 million iPhones globally in the fiscal first quarter report.

Samsung are trying to stop sales of the 4s in Australia and Japan, claiming that Apple are breaching patents. They have filed for injunctions in Tokyo and New South Wales Registry in Australia to stop the iPhone 4S being sold. The iPad 2 is also listed as infringing on their patents. Samsung are expanding the request for a sales block into other countries, including Italy.

Samsung have been hurt in recent months when Apple won an injunction, stopping sales of their Galaxy Tab 10.1 in certain countries. A claim that Samsung are still fighting. James Chung, a Samsung spokesman said “We are actively responding in the legal battle with Apple.”

The iPhone 4S may have been well received by customers, but a portion of the analyst market have been less than impressed with the new phone, claiming the design is nothing new and that they had hoped for a new case design. With a new camera, faster processing power and new voice activated artificial intelligence technology the punters seem satisfied.

Well it won't come as much of a shock to hear that Apple are already on track for a monumental first month after the release of their new iPhone 4s. While the press have been rather muted in response to the ‘tweaked' new design, it appears that the punters don't really care. People have been camping out to get their hands on the new phone and sales could hit 4 million this weekend.

The iPhone 4s will be remembered as the last phone which was developed under Steve Jobs reign, and today it will be available in many parts of the world, such as the U.K. Germany, France, Canada and Japan. When the iPhone 4 was released it sold 1.7 million units in the first weekend which at the time was incredible. The iPhone 4s is estimated to sell between 2 and 4 million this weekend, depending on which analyst firm you speak to.

The ongoing legal battle between Samsung and Apple intensifies as Samsung are now claiming that the iPhone 4S violate their patents. Samsung are seeking to block the sale of the product in France and Italy.

Samsung have so far, been rather passive with Apple, having had their Galaxy Tab 10.1 blocked from sale in Australia and other parts of the world. Samsung are claiming that the iPhone 4S is breaching patent guidelines for use of wireless telecommunications technology – or more specifically for their wide ban code division multiple access standards for mobile handsets (WCDMA).

Samsung's injunction requests may expand to other countries after they review the matter further, according to the company.

Samsung issued a statement “The infringed technology is essential to the reliable functioning of telecom networks and devices, Apple has continued to flagrantly violate our intellectual property rights and free-ride on our technology, and we will steadfastly protect our intellectual property.”

Apple have not yet commented on the matter, however they are currently dealing with the death of their co-founder Steve Jobs, aged only 56.

We doubt this is the last we will hear of the legal battle between both companies, who have been at loggerheads all year after Apple initiated legal proceedings against Samsung in April. Apple claim that Samsung's smartphones and tablets ‘slavishy copy' designs of their own iPad and iPhone devices.

Three images leaked yesterday which are claimed to be a disassembled iPhone 4s device, attached to an A5 processor. There is much debate as to whether this could actually be the first images of the upcoming phone from Apple.

PhoneArena.com found a Chinese blogging site Weibo which appeared to be highlighted a new iPhone logic board which was connected to the back of a white iPhone 4 style panel. An A5 processor could be seen, alongside some cabling and a battery with LCD display.

No one is vouching that this is actually an unreleased iPhone 4s, but the evidence points to an unreleased Apple product.

This image was followed up later with MacPost publishing a picture of a device, which looked very similar to the iPhone 4. later, Pandaxtech leaked another image which shows a new main board, battery and the A5 processor. One of the images shows the phone powered on, and looking for an initial setup with iTunes.

Again, no one is officially confirming these images as being the upcoming iPhone release, but we would assume that the images are leaking from sources close to the release. Information sourced from MacRumors.
