Apple has won an agreement from Samsung Electronics, meaning that the company won't sell the newest version of their tablet in Australia until a patent lawsuit in the country is resolved.

The Galaxy Tab 10.1 apparently infringes ten patents from Apple which include touchscreen technology in the iPad. Apple went for an Australian injunction and they want to stop Samsung selling the tablet in other countries according to Steven Burley, a lawyer for Apple. The locational details were not mentioned.

Samsung has bowed under pressure from Apple and have agreed to stop advertising the Galaxy Tab 10.1 in Australia and will not sell the device until it wins court approval, or the lawsuit is resolved. If Apple loses the lawsuit then they will have to pay Samsung unspecified damages.

Apple have been claiming that Samsung are imitating the designs and technologies used for the iPad and iPhone. Their relationship is strained, even though Samsung supply memory for Apple.

The case is: Apple Inc. (AAPL) v. Samsung Electronics Co. NSD1243/2011. Federal Court of Australia (Sydney).

Kitguru says: Will this injunction start creeping into other countries?

Latest figures in show that the Samsung Galaxy Tab has sold just over 1 million units in two months, after it has gone on sale outside the U.S. This is a good showing for the Android powered tablet, especially in such a tough marketplace.

Apple's 9.7 inch iPad sold over 1 million units in a single month, after going on sale in April of this year. We spoke to various carriers recently and they said that the Samsung Galaxy Tab sales were very healthy indeed and showed that there is a market beyond the iPad. Detailed figures have not yet been released for the popular American thanksgiving holiday time period but Samsung have confirmed that over 1 million sales have been reached.

Apple's iPad continues to dominate this sector with little in the way of direct competition as yet. With over 4 million sold in the fourth quarter, ending October 31st it looks to be going from strength to strength.

KitGuru says: We are pleased to see so many people adopting the Galaxy Tab in its early months, as the Google Android mobile OS is a great platform which we hope will continue to flourish and grow in 2011.
