 Pokémon is the biggest media franchise of all time, and part of that success is due to the immense sales that each video game title manages to achieve. As with many Switch games, the most recent entries in the mainline franchise, Pokémon Sword/Shield and Brilliant Diamond/Shining Pearl, are likewise seeing this success, with both sets of games breaking Nintendo records.

Nintendo recently updated its list of lifetime game sales. Since the last Quarterly update, Pokémon Sword and Shield have managed to knock Gold and Silver off their silver podium to become the second best-selling Pokémon game of all time with 23,900,000 copies compared to Gold/Silver’s 23,700,000 copies.

Of course, Sword/Shield have a long way to go if they want to dethrone 1st place, however, because with 31,380,000 copies sold, Pokémon Red/Green/Blue continues as the best-selling game in the franchise. Pokémon Sword/Shield certainly has the potential to take first place, but with how many Pokémon games are released each year, the games don’t have quite as long tails as some other Nintendo properties.

One of the other recent Pokémon releases is Brilliant Diamond and Shining Pearl. With just under 14 million copies sold, the remake, which was only released in the 3rd week of November 2021, is on pace to become the fastest selling Pokémon remake of all time. Currently it is in 3rd place, with Let’s Go Pikachu/Eevie selling 14.33 million and Omega Ruby/Alpha Sapphire reaching 14.46 million copies sold in their first month and a half on the market.

While no data is currently available for the newest entry in the franchise, Pokémon Legends Arceus, early impressions are positive, and so it is safe to say that Pokémon is currently having a strong moment. Hopefully Game Freak is able to carry this momentum into the future.

In the run up to Pokemon Sword and Shield's launch last year, there were a number of leaks revealing large numbers of Pokemon and unannounced details ahead of release. Nintendo has obviously been investigating the source of these leaks since then and in a rare turn of events, Nintendo has publicly named the source and blacklisted a website.

Nintendo and The Pokemon Company issued a joint statement this week announcing that a small Portuguese website called ‘FNintendo' has been blacklisted. The site received a review copy of the game under NDA and has been deemed the source of leaks, breaking the NDA that was in place.

“In early November, Nintendo identified a number of photographs taken from game play that revealed multiple new and unannounced Pokémon from Pokémon Sword and Pokémon Shield. These photographs had been posted online and Nintendo, together with The Pokémon Company, quickly identified the person responsible for these leaks, and took immediate action. These Pokémon were leaked by a reviewer for the Portuguese website FNintendo, who had received an early copy of the game for review purposes. Both he and FNintendo failed to handle confidential material, resulting in a clear breach of the confidentiality agreement between Nintendo and the media outlet. As a result, Nintendo will no longer work with FNintendo.”

When a website breaks review embargo, it isn't uncommon for repercussions to follow. However, it is rare for a publisher to issue a public statement like this. As you might expect, FNintendo has also issued its own apology and the reviewer responsible has been let go. The site previously had an 11-year long relationship with Nintendo, so having direct ties severed in a public fashion like this is particularly noteworthy. So far, there is no talk of direct legal action taking place, so the site should still live on, but it will no longer get early access to Nintendo's published games for review.

KitGuru Says: We've heard quite a lot about how publishers track down NDA breakers recently, with Epic Games going after Fortnite leakers and Nintendo cracking down on leaks too. Following all of this, it will be interesting to see how review copies are handled for upcoming Nintendo games and the Pokemon Sword and Shield expansions. Something like this could cause issues for other independent sites looking to publish launch-day reviews.

Over the last couple of months, we have seen Epic Games taking legal action against testers who leaked Fortnite Chapter 2 details ahead of launch. Now, The Pokemon Company is taking similar action against those behind the Pokemon Sword and Shield leaks, claiming that they caused irreparable damage to the company. However, the actual identities of those involved still need to be figured out first. 

The Pokemon Company's lawsuit was filed at a court in Washington, Seattle, naming up to three ‘John/Jane Does'. Once the exact identities of the leakers are found, the legal complaint documents will be updated accordingly but for now, they remain anonymous. However, that doesn't mean that the Pokemon Company's investigation hasn't got them close to that goal, in fact, the lawyers on the case seem to have evidence of how the leaks circulated already.

According to the complaint, defendants allegedly stole trade secrets from the Pokemon Sword and Shield strategy guide on the 1st of November. The leaks took place over Discord messages, with 18 photos of the unreleased guide being spread, which were then publicly posted all across the web to a worldwide audience.

The strategy guide was due to release on the 22nd of November, one week after Sword and Shield. The Pokemon Company runs background checks, marks files and restricts access to any game information during development, NDAs are also required for every employee, including contractors and production vendors. Only production facility employees “with the proper security clearance” have access to the actual guide during production and there is a ban on phones or cameras in secured areas.

With that in mind, one of those security measures apparently failed in November, allowing a ton of images from the guide to be taken and sent off-site. The strategy guide leak was just the start though, with leaked gameplay videos also popping up shortly after, leading to a trending hashtag where fans accused Game Freak of lying about Sword and Shield.

Due to all of this, The Pokemon Company wants to be compensated for the damage the leaks caused. First, the company will need to figure out the identities of those involved but given that the Discord leaks are already in their possession, they will likely figure it out at some point, particularly if a judge orders Discord to hand over any identifying information for the accounts involved.

KitGuru Says: The Pokemon Company has a digital footprint to follow, just as Epic Games did with its own lawsuit against leakers earlier this year. With that in mind, this case is likely to updated with actual named defendants at some point. Pokemon is one of the biggest brands in the world too, so ‘compensatory damages' for violating NDA could end up being quite large. What do you all think of this? Pokemon Sword and Shield being a huge success would have been one of the easiest video game predictions you could have made this year. There might be some controversy surrounding the release, but so far, that has not hurt sales, with the game becoming the fastest selling Switch title to date.

From Friday until the end of Sunday last week, Pokemon Sword and Shield sold six million copies worldwide, beating out Super Smash Bros. Ultimate as the fastest selling Switch game in its first week. By comparison, Pokemon X and Y sold four million in its first week and Super Smash Bros. Ultimate sold five million in its first week.

With six million copies sold so far, Pokemon Sword and Shield have also earned a spot in the top-ten highest selling Switch exclusives to date, slotting it between Super Mario Bros U. Deluxe and Super Mario Party. Currently, Pokemon Let's Go has sold over 11 million copies since release, so we will likely see Sword and Shield overtake it in the months to come.

Here in the UK, physical retail charts show that Pokemon Sword is the more popular option, with the game coming in at number one, while Shield follows in third place for the week of November 11-17.
